Riceviamo e pubblichiamo, per la sua rilevante importanza sui servizi ospedalieri anche nel territorio di Sciacca, il seguente comunicato pervenutoci dal sindacato dei medici aderente alla Fondazione CIMO – FESMED:
CIMO AI FERRI CORTI CON L’ASP DI AGRIGENTO. BONSIGNORE E SPAMINATO: “A BREVE PARTIRA’ UNA DENUNCIA PER COMPORTAMENTO ANTISINDACALE”
“Mancata fruizione di ferie e riposi, orari di servizio esorbitanti che non rispettano nemmeno lontanamente il tetto massimo consentito dalla normativa europea, disposizioni di servizio relativi a mobilità d’urgenza che vanno ben oltre i 30 giorni nell’anno solare previsti dalla normativa vigente, mancata attribuzione degli incarichi dirigenziali dal 2010. Sono questi alcuni elementi di profondo disagiodenunciati dai medici dell’ASP di Agrigento, nel corso dell’Assemblea sindacale del CIMO che si è svolta ieri nella sede dell’Ordine dei Medici di Agrigento”.
“Riguardo a tali problematiche CIMO, insieme ad altre organizzazioni sindacali, ha chiesto confronto urgente alla direzione aziendale, che ha impiegato tuttavia circa 10 giorni per rispondere e si è presa altri 15 giorni per dichiararsi “disponibile” al confronto. Evidentemente il concetto di “urgenza” all’ASP di Agrigento è del tutto relativo” –affermano Giuseppe Bonsignore (segretario regionale CIMO) e Riccardo Spampinato (presidente regionale della Federazione CIMO-FESMED) – . All’Assemblea è intervenuto in videoconferenza il Prof. Marzio Scheggi, Presidente di Health Management e Consulente CIMO, uno dei massimi esperti nazionali di legislazione sanitaria che (dopo avere esaminato nelle scorse settimane le buste paga di molti medici agrigentini), ha dichiarato: “l’ASP di Agrigento ha ignorato del tutto l’applicazione del ‘nuovo’ CCNL”, quello cioè firmato il 19 dicembre 2019 con palese e a volte rilevante danno economico per i medici dell’ASP diretta dal Commissario Mario Zappia. “CIMO ha già avviato le procedure per intentare un’azione legale a tutela dei propri iscritti – sottolineano i due dirigenti sindacali – e far loro recuperare il maltolto”.
“Inoltre, è da segnalare il fatto deplorevole che alSegretario Aziendale CIMO, dottoressa Rosetta Vaccaro, non è stato concesso di partecipareall’Assemblea degli iscritti CIMO dell’ASP di Agrigento”..
“È un fatto di una gravità inaudita – tuonano Bonsignore e Spampinato – aver di fatto impedito ad un dirigente sindacale di svolgere il proprio ruolo istituzionale. È stato leso un diritto fondamentale sancito dallo Statuto dei Lavoratori, diritto che riguarda tutti i dipendenti dell’Azienda ma in modo particolare i rappresentanti sindacali. Sembra quasi che ci sia un comportamento persecutorio nei confronti della nostra Dirigente Sindacale dal momento che quello di oggi è l’ultimo di una serie di dinieghi relativi a ferie o permessi, addirittura per espletamento di visite mediche, che subisce la dottoressa Vaccaro, ogni volta con motivazioni risibili, ma oggi è stata la classica goccia che ha fatto traboccare il vaso ed è per questo che abbiamo subito dato mandato al nostro legale di presentare una denuncia nei confronti di tutti i soggetti che a vario titolo si sono resi responsabili di tali inaccettabili comportamenti”.
“Nel frattempo proprio ieri è finalmente intervenuto, su richiesta CIMO, l’Ispettorato del Lavoro che, qualora dovesse accertare le numerose irregolarità da noi segnalate, non potrebbe far altro che sanzionare pesantemente l’ASP con conseguente (e forse rilevante) danno erariale di cui qualcuno dovrà prima o poi rispondere. Non è escluso che a fronte delle continue vessazioni cui vengono sottoposti i medici agrigentini,CIMO possa intentare causa risarcitoria per il danno arrecato agli stessi, ormai privati di una propria vita sociale e dei diritti fondamentali previsti da precise norme di legge.
